North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushed by hazard. a)Truck Repair Area: employer did not establish or maintain a periodic qualified inspection procedure in accordance with the automotive lift manufacturer's recommendations to ensure the safe operation of the lift. Reference: ANSI/ALI 2000 (American National Standards Institute/Automotive Lift Institute) Standard for Automotive Lifts - Safety Requirements for Operation, Inspection, and Maintenance. ANSI/ALI - 2000 (Section 5.1, Page 6): Qualified Inspection Procedure: The owner or employer shall establish a periodic inspection procedure in accordance with the recommendations of the lift manufacturer in order to ensure reliability and allow the safe operation of the lift. Please be reminded that certain sections of U.S. Code of Federal Regulations, Title 29, Section 1910 and applicable subparts - Occupational Safety and Health Administration, General Industry Standards may pertain to the procedures anticipated by this section. Compliance with applicable regulations is left to the person(s) involved.
