11.5.1.13 NMAC 50-9-5.A NMSA 1978: The employer did not furnish each of his employees employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: Employees were exposed to eye injury, including corneal damage, from potential contact with injurious materials when spraying products containing Chlorpyrifos and other chemicals. The employer did not regularly test and flush emergency eyewash equipment to ensure proper operation. Serious physical harm, including corneal damage, may result from employee exposure. Recognition of the requirement to provide adequate emergency eyewash facilities was available to the employer through the product labeling. One feasible and acceptable method to abate this hazard is to comply with ANSI Z358.1 as follows: Employer shall ensure the dependability of all emergency eye wash facilities through protection from freezing, deterioration, physical damage, and through appropriate inspection and maintenance.
