Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer failed to furnish a safe place of employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees as follows: a.Located at the 1117 South Commerce Street, both indoor and outdoor, and 1420 South Commerce Street the employer used pallet racks to store various products such as dishwashers, refrigerators, cooking ranges, commercial coolers. bar stools, various boxes of paperwork, appliance parts, and kitchen supplies. In addition, a forklift was used to stack pallet racks at the 1420 South Commerce Street location. The racks at all locations had not been anchor bolted to the floor therefore making them capable of resisting the forces caused by the horizontal and vertical loads placed on the racks by forklifts. b.Located at the 1117 South Commerce Street, both indoor and outdoor, and 1420 South Commerce Street the employer did not ensure that all pallet racks displayed in one or more conspicuous places a plaque indicating the maximum permissible unit load and/or maximum uniformly distributed load per level, the average unit load if applicable, and the maximum total load per bay. ABATEMENT: A reasonable means of abatement would be to follow American National Standard Institute MH16.1:2008 as follows: 1.4.2 Plaque - The owner is responsible for displaying in one or more conspicuous locations a permanent plaque(s). Each plaque shall have an area of not less than 50 square inches. Plaques shall show in clear, legible print (a) the maximum permissible unit load and/or maximum uniformly distributed load per level, (b) the average unit load (PL Average, see Section 2.6.2) if applicable and (c) maximum total load per bay. The unit load is usually a single pallet or container ind its contents mechanically transported. Storage levels having multiple stacking of unit loads shall be so identified. It is the responsibility of the owner to ensure that the rack system is not altered so that the plaque information is invalidated. 1.4.7 Column Base Plates and Anchors - The bottom of all columns shall be furnished with column base plates, as specified in Section 7.2. All rack columns shall be anchored to the floor with anchor bolts capable of resisting the forces caused by the horizontal and vertical loads on the rack.
