Nevada Revised Statute 618.375(1):  Duties of employers.  Every employer
shall furnish
employment and a place of employment which are free from recognized
hazards that are causing
or are likely to cause death or serious physical harm to his or her
employees:
At 10000 Cottonwood Cove Road, Searchlight, NV, the employer failed to
furnish employment
and a place of employment which are free from recognized hazards that are
causing or are likely
to cause death or serious physical harm to his or her employees, as
follows:
a.The employer did not ensure that an employee did not step or stand
higher than
the step or rung indicated on the label marking the highest standing level
of the
ladder.
b.The employer failed to ensure that the employee did not step or stand on
the top
cap and the top step of a step ladder.
c.The employer failed to ensure that the ladder extended approximately
three feet
above the upper access level. The ladder was not tied to the upper access
level
before climbing onto or off the ladder at the upper level.
An employee was seriously injured while replacing the carpet on the front
of a monohull
houseboat that had been removed from the water for a summer refurbishment.
The employee
stepped from the deck, which was 91 inches above ground level, onto the
top cap of a six foot
aluminum ladder. The ladder displaced and the employee fell to the ground
fracturing his ankle
in three places.

"Ladder should
extend approximately three feet above the access level. The ladder shall
be tied to the
upper access level before climbing onto or off the ladder at the upper
level. The user
shall take care when getting on or off the ladder at the upper level in
order to avoid
tipping the ladder over sideways or causing the ladder base to slide."
One feasible and acceptable abatement method would be to follow the
requirements
of the
American National Standard Institute A14.2-2000, for Ladders - Portable
Metal - Safety
Requirements when using portable metal ladders to perform work or access
upper levels.
