Nevada Revised Statute 618.375(1):  Duties of employers.  The employer
failed to furnish
employment and a place of employment which was free from recognized
hazards that were
causing or likely to cause death or serious physical harm to his employees:
The employer failed to furnish employment free from recognized hazards, as
follows:
a.At the Shuffle Master warehouse area, employees stacked heavy items and
merchandise on steel storage racks approximately 20 feet high. The storage
racks
have damaged vertical members and missing pallet load support members. The
employees were exposed to possible serious injuries or death in the event
of an
emergency.
Reference: ANSI MH16.1:2008 - Specification for the Design, Testing and
Utilization of Industrial Steel Storage Racks:
Section 1.4.1.2. Owner Maintenance. Regularly inspect for damage. If damage
is found, immediately unload the affected area and replace or repair any
damaged
columns, beams, or other structural components.
Section 1.4.1.4. Owner Maintenance. Ensure that pallets are properly
placed onto
pallet load support members in a properly stacked and stable position.
Section 1.4.2. Plaque. The owner is responsible for displaying in one or
more
conspicuous locations a permanent plaque(s). Each plaque shall have an
area of
not less than 50 square inches. Plaques shall show in clear, legible print
(a) the
maximum permissible unit load and/or maximum uniformly distributed load per
level, (b) the average unit load.
Section 1.4.9. Rack Damage. Second Paragraph. Upon any visible damage, the
pertinent portions of the rack shall be unloaded immediately by the used
until the
damaged portion is repaired or replaced.
One feasible means of abatement would be to ensure that each structural
steel
rack be inspected regularly, plaques showing permissible and average unit
load,
ensure pallets are properly placed onto pallet load support members, base
plates
anchored properly, and repair each damage steel member immediately.
