Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: At the Icee company, a warehouse was not free from recognized hazards, as follows: 1. A pallet rack located on the southwest side of the warehouse was not secured to the floor to prevent it from tipping over in the event that an accidental bump with a forklift occurs or in the event of a seismic activity. 2. Three vertical members of an installed pallet rack on the north side of the warehouse had visible physical damage or dents posing serious safety hazards.
