Nevada Revised Statute 618.375(1):  Every employer did not furnish
employment and a place
of employment which was free from recognized hazards that were causing or
were likely to
cause death or serious physical harm to his employees:
The employer did not furnish employment and a place of employment which
was free from
recognized hazards that were causing or likely to cause death or serious
physical harm to his
employees, as follows:
a)In the shipping and receiving sections of the warehouse, the employer
did not
ensure that all storage racks displayed in one or more conspicuous places
a
plaque
indicating the maximum permissible unit load and/or maximum uniformly
distributed load per level, the average unit load if applicable, and the
maximum
total load per bay.
ABATEMENT: A reasonable means of abatement would be to follow American
National Standard Institute MH16.1:2008 as follows:
1.4.2 Plaque - The owner is responsible for displaying in one or more
conspicuous locations a permanent plaque(s). Each plaque shall have an
area of not less than 50 square inches. Plaques shall show in clear,
legible
print (a) the maximum permissible unit load and/or maximum uniformly
distributed load per level, (b) the average unit load (PL Average, see
Section 2.6.2) if applicable and (c) maximum total load per bay. The unit
load is usually a single pallet or container ind its contents mechanically
transported. Storage levels having multiple stacking of unit loads shall be
so identified. It is the responsibility of the owner to ensure that the
rack
system is not altered so that the plaque information is invalidated.
b) In the shipping and receiving sections of the warehouse, the employer
did
not ensure
that all storage racks were regularly inspected for damage. Racks CV2-0-23
and CV4-02-
23 had noticeable damage from being hit with a lift truck; an unmarked
support rack,
near the maraschino cherries, had significant damage to it; the storage
rack near the
opening between the shipping and receiving sections of the warehouse was
bent.
ABATEMENT: A reasonable means of abatement would be to follow  American
National Standard Institute MH16.1:2008 as follows:
1.4.1 Owner Maintenance (2): Regularly inspect for damage. If damage
is found, immediately unload the affected area and replace or repair any
damaged columns, beams or other structural components.
1.4.9 Rack Damage: Upon visible damage, the pertinent portions of the
rack shall be unloaded immediately by the user until the damaged portion
is repaired or replaced.

Nevada Revised Statute 618.375(1):  Duties of employers.  The employer
failed to furnish
employment and a place of employment which was free from recognized
hazards that were
causing or likely to cause death or serious physical harm to his employees:
The employer did not ensure a safe place of employment and a place of
employment which was
free from reognized hazards that were likely to cause death or serious
physical harm to his
employees, as follows:
a) In the receiving and shipping sections of the warehouse, employees were
allowed to
operate a Hyster Ordermaster powered industrial truck without an effective
personal fall
arrest system in place.
1. The employer had allowed the employees to operate the Hyster lift with a
Madaco Tuff-Shox 6 foot lanyard with a shock-absorber. Employees could work
up to approximately 20 feet in the air with the Hyster lift. If the
employees
worked at a lower height and fell off the lift, the employee could hit the
ground.
The employees were exposed to serious injury due to not using the proper
lanyard
with the personal fall arrest system as required by the manufacturer.
ABATEMENT: A reasonable means of abatement would be to follow the
manufacturer's operating manual as follows:
Page 23, Warning: The operator MUST ALWAYS wear the tetherline and safety
harness when operting the lift truck. The tetherline is specially made to
lessen the
shock of a fall and help prevent injury to the operator. Make sure the
tetherline
is installed before operating the lift truck.
Page 50: Warning: The tetherline is specially made to lessen the shock of
a fall.
Do not substitue other types of rope.
2. The employer had allowed the employees to operate a Hyster Ordermaster
powered industrial truck with a Madaco Tuff-Belt personal fall arrest
harness that
was damaged. The snaphook attached to the Hyster lift was bent. The other
snaphook was missing a pin, which made the snaphook stick when it was
opened.
The adjustable leg strap was cut, and chest strap had small holes in it.
ABATEMENT:  A reasonable means of abatement would be to follow the
manufacturer's operating manual as follows:
Pafe 50 2.: Inspect the safety harness for cracks, cuts or wear.
