Nevada Revised Statute 618.375(1): Every employer shall furnish employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his or her employees. The employer failed to ensure that the workplace was free from recognized hazards as follows: a.An employee operated a Segway X2 personal transport, in the performance of his job duties at the Borgata Condominium complex. When the employee was operating the Segway the maximum payload of 260 pounds was exceeded. The employee weighed approximately 311 pounds, not including additional cargo. Exceeding the machine's payload can effect the stability of the machine, exposing the employee to possible serious injury. One feasible means of abatement would be to follow the recommendations of the owner's manual, which states the following: a. Warning, Exceeding the weight limits, especially when combined with other variables that require more power, will increase your risk of falling or damaging the Segway PT. b. Table 2. Segway Specifications for the X2 list the max payload (rider plus all cargo) at 260 pounds.
