Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of informing the host employer when performing work task on the Automated People Mover (APM) of the companies energy control procedures to prevent the hazard of being electrocuted, struck-by and caught-in by the rail, train and other components of the Automated People Mover (APM) system which are causing or likely to cause death or serious physical harm to employees: This violation was observed on or about October 26, 2010, where Johnson Controls was not informed of Webber's energy control procedures when performing service, maintenance and other work tasks on the APM guide-way. Among other feasible methods to correct the identified hazard, one method would be for the on-site employer (host) and the outside employer (contractor) to inform each other of their respective lockout/tagout programs per ANSI / ASSE A10.44-2006 Control of Energy Sources (Lockout/Tagout) for Construction and Demolition Operations, Section 6.4. Disclaimers: 1.You are not limited to the abatement methods suggested above. 2.The methods explained are general and may not be effective in all cases. 3.The employer is responsible for selecting and carrying out an appropriate method of abatement. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to ensure that Johnson Controls is informed of Webber's energy control procedures when performing service, maintenance and other work tasks on the APM guide-way.
