Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to:Every pit and trapdoor floor opening, infrequently used, shall be guarded by a floor opening cover of standard strength and construction. While the cover is not in place, the pit or trap opening shall be constantly attended by someone or shall be protected on all exposed sides by removable standard railings On or about September 21, 2010 and times thereto at the grain drier facility located at 302 Highway 65 North, McGehee, Arkansas an employee of Riceland Foods, Inc. was exposed to the hazard of falling from one level to another through an unguarded floor opening . An employee was working in the Drier Office when he was summonsed via radio by the foreman to come to the boot pit area to assist with the vacuuming of the excess grain. The employee traversed from the Drier Office to the boot pit area and fell through the floor opening to the lower level, approximately 21' 6" in below.
