Section 5(a)(1) of the Occupational Safety and health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, including struck by or crushing hazards, to employees in that employees were exposed to the hazards of being struck by materials being handled with a hoist being operated with a hook whose latch did not effectively close the hook's throat: (a) Vibe room: The latch on the hook of the Budget 1/2 ton electric hoist was broken, and did not effectively close the throat of the hook, and was not removed from service or moused until the latch was replaced or repaired, on or about 2-28-12. AMONG OTHER METHODS, A FEASIBLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO ABIDE BY ANSI B30.10-2005 SECTION 10-1.2.3 (d) WHICH STATES "A HOOK WITH A LATCH THAT DOES NOT CLOSE THE THROAT OPENING SHALL BE REMOVED FROM SERVICE OR MOUSED UNTIL THE LATCH IS REPLACED OR REPAIRED".5
