Labor and Employment Article, Section 5-104(a), Annotated Code of Maryland: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:09/22/10 Location:Site Yard Equipment:Pettibone Material Lift, Model: #8044, Serial: #2253 Condition:An employee was observed operating a rough terrain forklift on the work site without wearing the seat belt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that the employee utilized the existing seat belt while operating the equipment. The proposed penalty for this item has been reduced by 50for effective and efficient abatement during the inspection.
