Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: At the worksite: On or about March 1, 2011, and at times prior thereto, the employer allowed an employee to operate a rough terrain type forklift, Sky Track model 6036, serial number 0160026996 without the operator being at the controls of the machine while another employee was working from an elevated work platform supported by the forklift. Employees were exposed to the hazards associated with fall from heights, struck-by, and caught in between. Among others, one feasible and acceptable method of abatement would be to comply with American Society of Mechanical Engineers (ASME) Safety Standard For Rough Terrain Forklift Trucks, ASME B56.6-2002.
