Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm during use
of the restaurant
dumbwaiter:
On or about March 4, 2011 and at times prior thereto, employees were
exposed
to struck by
hazards while using the dumbwaiter to transport restaurant stock between
floors of the
establishment. These hazards were created by the following conditions:
a) A 1/2 ton Dayton electric chain hoist was used to raise and lower the
dumbwaiter cart.
The manufacturer does not recommend the hoist be used for lifting
dumbwaiters and
elevators.
b) There was no placard, plate, or sign posted in a conspicuous place
indicating the
maximum rated load of the dumbwaiter cart.
c) The hoist was loaded beyond its 1/2 ton (1,000 pound) capacity.
d) The dumbwaiter platform area exceeded the minimum allowable of 9 square
feet.
Among other methods, a feasible and acceptable abatement method is to
ensure any elevator
and/or dumbwaiter in the establishment conforms and complies with the
American National
Standard Safety Code For Elevators, Dumbwaiters, Escalators and Moving
Walks (ANSI
A17.1), The American Society of Mechanical Engineers for Overhead Hoists
(ASME B30.16),
and the Dayton Operating Instructions for the 1/2 Ton Electric Chain
Hoists.
