Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: On or about November 11, 2011, and times prior thereto, at Gore Nitrogen Pumping Service, LLC, located in Seiling, Oklahoma, for the following: a) The employer did not ensure employees wear a seatbelt while operating the Toyota model 42-6F GCU30 forklift, S/N 61490. b) The employer did not ensure the Hyster model X4.00XL-5 forklift, S/N G005A09756V, was equipped with a seatbelt. This exposes employees to struck-by, caught-in and/or crushed-by hazards.by
