Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: Plant area: On or about December 13, 2011, and times prior to, the employer did not ensure employees were protected from struck-by or crushing hazards during the operation of the Caterpillar 966C Loader (Series C, S/N 76J3767). The backup alarm and the horn on the loader were not functional. Among other methods, feasible and acceptable abatement methods to correct these hazards are to comply with the manufacturer's instructions for the safe use of the Caterpillar 966C Loader (Series C, S/N 76J3767).
