North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the risk of being caught in a trench collapse: a)facility-the employer did not ensure that all employees who were responsible for responding to trench rescues were able to recognize the hazards and unsafe conditions associated with entry into trenches and excavations concerning rescue and retrieval operations. NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to train all employees who are exposed to trench rescue to identify existing and predictable hazards in the surroundings, or working conditions, which are unsanitary, hazardous, or dangerous to employees.
