Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and amputation hazards while riding the dumbwaiter platform due to the passenger car was not fully enclosed: LOCATION: Establishment Between the Workroom Floor and Basement a) The dumbwaiter in which employees were riding to retrieve bakery supplies did not have a car enclosure, thus exposing employees to amputation and falling hazards on or about 12/10/10. Among other methods, one feasible means of abatement is to equip the dumbwaiter with a car enclosure, as outlined in the Safety Code for Elevators and Escalators, ASME A17.1-2010/CSA B44-10 section 7.2.1 (Revision of ASME A17.1-2007 and CSA B44-07) NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.ce

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while riding the dumbwaiter platform due to the dumbwaiter door was not equipped with a contact that would prevent the operation of the driving machine, unless the door or gate panels is in the closed position: LOCATION: Establishment Between the Workroom Floor and Basement a) The dumbwaiter in which employees were riding to retrieve bakery supplies in the basement did not have a door with a contact that would prevent the operation of the driving machine, thus exposing employees to falling from the workroom floor to the basement below on or about 12/10/10. Location: Establishment, Basement b) The dumbwaiter in which employees were riding to retrieve bakery supplies in the basement did not have a door with a contact that would prevent the operation of the driving machine, thus exposing employees in the basement to crushing hazards on or about 12/10/10. Among other methods, one feasible means of abatement is to install a door with a contact, as outlined in the Safety Code for Elevators and Escalators, ASME A17.1-2010/CSA B44-10 section 7.2.1.2.2 (Revision of ASME A17.1-2007 and CSA B44-07) NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.ce
