Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by loads being lifted by
overhead hoist equipment
which had not been inspected:
a)2nd Floor and 3rd Floors:  Hoists that were used for lifting tote tanks
of paint
were not inspected; on or about 1/25/11.
NOTE: The employer is required to submit abatement certification for this
item in
accordance with 29 CFR 1903.19.
Among other feasible methods the following methods of abatement would
eliminate the hazard
identified:
1. Perform inspections in accordance with ASME B30.16-2007 Overhead Hoists
(Underhung).
