Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being crushed by the moving parts of a
compactor:
Location: 70 West Third Street in Mount Vernon, NY
a) Employees operate a stationary compactor (Royal-Pak Type LH Model EK
Series 883)with
the access door open, which exposes them to moving parts (e.g., ram) at
the point of operation;
on or about July 5, 2011.
AMONG OTHER MEASURES, ONE FEASIBLE AND ACCEPTABLE METHOD TO
CORRECT THIS HAZARD IS TO FOLLOW THE ANSI Z245.2.204, WHICH STATES
THAT THE OWNER/EMPLOYER SHALL ENSURE THAT THE ACCESS GATE OR DOOR
IS INTERLOCKED IN SUCH A MANNER AS TO PREVENT THE MOVEMENT OF PARTS
AT THE POINT OF OPERATION WHEN THE SAID GATE OR DOOR IS OPEN.
NOTE: Because abatement of this violation is already documented in the
inspection case
file, the employer need not submit certification or documentation of
abatement for this
violation as normally required by 29 CFR 1903.19.
