Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards which were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to crushing injuries while operating a forklift that was not equipped with an operator restraint system: a) On or about November 30, 2010 and at times prior, employees were exposed to crushing injuries in the event of a turn-over, while operating a forklift that was not equipped with an operator restraint system (seat belt). Among other methods, a feasible and acceptable method to correct this hazard is to install and use an operator restraint system (seat belt). Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").
