Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employees a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees, in that employees were exposed to crushing hazards: a) On or about November 23, 2010 and at times prior, employees were exposed to crushing injuries in that, the employer did not ensure employees operating the Broce Broom, Model H-10 were utilizing a seat restraint when a tip-over occurred. ABATEMENT NOTE: A feasible means of abatement of these hazards include, but not limited to, to the following: (a) Ensure seat belts are used by operators and that they understand the importance of how seat belts and ROPS (Roll Over Protection) function together. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").-Certification
