Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were not monitored for ionizing radiation levels. (a) On or about December 29, 2010, and at times prior, employees were exposed to ionizing radiation hazards from operation of x-ray dental equipment. Monitoring was not conducted to determine employee exposure to ionizing radiation. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARDOUS CONDITION WOULD BE TO: 1. Comply with Colorado Department of Public Health and Environment Standards, Section 4.18 "Conditions Requiring Individual Monitoring of External and Internal Occupational Dose", which states: "Each licensee or registrant shall monitor occupational exposure to radiation at levels sufficient to demonstrate compliance with the occupational dose limits of Part 4".
