Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that,
employees were exposed to asphyxiation:
(a) On or about February 23, 2011, and times prior, employees were exposed
to serious
crushing and asphyxiation hazards when operating the unguarded Power
Take-Off (PTO) on
a dump truck.  An employee was fatally injured when he was in the process
of unloading
material and went underneath the dump truck where his jacket was caught in
the rotating
mechanism of the PTO.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard would be to guard the portion of the PTO that was unguarded.
Additionally,
employees should be instructed and trained in the proper and safe
operation
of
equipment.
Abatement Verification:  Abatement certification and documentation is
required for this
item (see enclosed "Sample Abatement-Certification Letter").
