Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment or a place of employment which was free from recognized
hazards
which were likely to cause death or serious physical harm to employees in
that, employees
were exposed to struck-by hazards:
a)  On or about March 8, 2011, and at times prior, employees were exposed
to struck-by
hazards involving public vehicle traffic because the employer did not
ensure that a temporary
traffic control plan was in place to protect employees working on a
concrete ramp project
along Chaffee County Road 194.  The road had been closed with a sign,
however, the
closure was not effective as some public vehicles ignored it and entered
the worksite in order
to drive to the river parking lot.  The employer did not have a temporary
traffic control plan
and did not have a traffic control supervisor on site that could recognize
the hazard and
modify the conditions to abate the hazard.
Abatement:
Among other methods, one feasible and acceptable abatement method to
correct the hazards
would be to implement the requirements of the Manual on Uniform Traffic
Control Devices
(MUTCD) approved by the Federal Highway Administration.  Part 6 of the
MUTCD
requires a Temporary Traffic Control plan when diverting traffic in order
to protect workers.
Langston Concrete, Inc. should work with the Chaffee County to ensure that
a plan has been
developed.  Further, the Temporary Traffic Control plan should be
implemented by a trained
Traffic Control Supervisor who could recognize problems (such as
ineffective barriers) and
make the necessary adjustments to ensure worker safety.
