Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that overhead
underhung chain hoists were not tested, frequently and periodically
inspected exposing
employees to crushing and struck-by injuries if hoisting equipment were to
fail while being used:
a) On or about October 29, 2010 the overhead underhung chain hoists
located in the floor mold,
automatic and manual squeeze mold departments, maintenance shop, that had
damaged to the
lifting hooks as well as the hoist support located in the final inspection
department were not
inspected as follows:
1) Frequent inspections were not conducted prior to use or at least weekly
or monthly on the
overhead underhung chain hoists used for heavy service by the operator or
other designated
person(s) and hoists had apparent damage to lifting hooks. Lifting hooks
were bent, had throat
wear, and missing or broken safety latches.
2) Periodic inspections were not conducted by designated person(s), no
records kept, nor was
the equipment identified by any external code markings that would enable
the employer to track
inspections.
3) The home-made hoist support structure located in Final inspection
department, was not
reviewed or approved by a qualified person including consideration of
design calculations for
the load to be lifted.
Among other methods of abatement, one feasible and acceptable method to
correct this hazard
is to follow the inspection and maintenance procedures outlined in ASME B
30.16-2007
Overhead Hoist (underhung) reference section 16-2.1.1(b)(1)-(2) Inspection
Procedures; and
section 16-2.2.2(b) Testing hoist anchorage and suspension parts.
In accordance with 29 CFR 1903.19(d) abatement certification is required
for this violation, and
in addition, documentation demonstrating that abatement is complete. This
documentation may
include, but not limited to, evidence of the purchase or repair and test
of the equipment,
photographic or video evidence of abatement, or other written records.

were causing or likely to cause death or serious physical harm to
employees in that under-the-
hook lifting devices did not include a determination and marking of
lifting capacities, exposing
employees to crushing injuries if the lifting devices were to fail during
use:
a) On or about October 29, 2010 the under-the-hook lifting devices
utilized with hoists to lift,
carry and place molds located in the floor mold department did not have
their lift capacities
determined nor marked on the devices. The lifting devices were made up of
steel
spreader bars
and vertical hanging C-hooked shape round steel stock some of which were
made and or
repaired by the employer.
b) Lifting devices below the hook utilized with hoists to carry die molds
to and from the
automatic squeeze mold machine (Rotto lift) did not have their lifting
capacities determined nor
marked on them. The devices consisted of steel C-shaped lifting devices,
steel horizontal
spreader bars and vertical lifting bars which were made and or repaired by
the employer
arranged in different shapes and lengths. There were visual damages to the
lifting devices at the
lift holes where the hoist hook made contact with the lifting hole (eye).
c) Lifting devices below the hook utilized with hoists to lift and carry
die molds in the manual
squeeze mold department did not have their lifting capacities identified
and marked on them. The
lifting devices were made up using steel flat stock, round stock, and I
beam shapes and arranged
in different sizes and lengths.
Among other method of abatement, one feasible and acceptable method to
correct this hazard
is to follow identification procedures outlined in ASME B30.20-2006; Below
the Hook Lifting
Devices, reference section 20-1.2.1(a) Rated Load Markings; section
20-1.4.2(a) Rated Load
Test; and section 20-1.5.2 Adjustments and Repairs..
In accordance with 29 CFR 1903.19(d) abatement certification is required
for this violation, and
in addition, documentation demonstrating that abatement is complete. This

include, but not limited to, evidence of the purchase or repair and test
of the equipment,
