Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about November 29, 2010, at 5300 Jefferson Parkway in Pine Bluff, Arkansas, employees operating CAT forklift #6521 and CAT forklift #6105 in the main aisle way in the warehouse did not wear seat belts. This condition exposed employees to the hazard of being thrown, ejected and crushed in the event of a tip-over. One feasible and acceptable method for abatement would be to ensure the usage of seat belts, communicate the usage to employees and establish a disciplinary policy for violators.
