Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer does not
furnish employment and a place of employment which are free from
recognized hazards that are
causing or likely to cause death or serious physical harm to employees in
that employees are
exposed to struck by and/or crushing hazards:
On or about December 9, 2010, and at times prior thereto, employees were
working in
close proximity to a concrete grain silo that was structurally unsound.
Among other methods, feasible and acceptable means of abatement would be to
implement the recommendations of the professional engineers who inspected
the silos:
1. Construct a liner on the interior of the silo;
2. Construct a liner on the exterior of the silo;
3. Demolish the silo and construct a new silo.ruct
