Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:10/13/10 Condition:Employees were not protected from struck-by/crushed-by hazards posed by the swinging superstructure of an excavator. Among other methods, one feasible and acceptable method to correct this hazard is to erect a barricade around the swing radius of the superstructure of this equipment to prevent employees from being struck or crushed by it. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.

Among other methods, one feasible and acceptable abatement method to correct this hazard, have an eyewash that provides at least 15 minutes of continuous flow that complies with American National Standards Institute (ANSI) Z358.1, "Emergency Eye Wash and Shower Equipment". Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
