Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about May 10, 2011, an employee engaged in tree felling activities at 1127 W. 4th Ave., Hutchinson KS, was exposed to struck-by hazards. The employer did not develop, implement or train employees on a work plan for tree removal operations. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS: Develop, implement and train employees on a tree work plan in accordance with ANSI Z133.1-2006 Safety Requirements for Arborticultural Operations to include but not limited to: 1. The area surrounding the tree(s) to be removed, including nearby trees; 2. Species and shape of the tree; 3. Lean of the tree; 4. Loose limbs, chunks, or other overhead materials; 5. Wind force and direction; 6. Decay or weak spots throughout the tree; 7. Location and means to protect other persons, property, and electrical conductors; 8. Size and terrain characteristics or limitations of the work area; and 9. Evidence of bees or wildlife habitation in the tree. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is completed.
