Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck-by hazards: At jobsite 706 W. Euclid, McPherson, KS: An employee engaged in metal siding installation activities was exposed to fall hazards of approximately 4 feet from a pallet mounted on the forks of a skid steer and struck-by hazards in that the platform was not secured to the forks of the skid steer and the skid steer was driven while the employee was on the raised platform. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS: Develop procedures and train employee on the proper uses of Case 70XT Skid Steer. Procedures should include prohibited uses such as but not limited to the use of the skid steer as a means to elevate employees and work platforms. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is completed.
