Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: At the jobsite located approximately 1.5 miles south of Dresden, KS on Highway 123: Employees engaged in material clearing activities at the recycle hopper were exposed to fall hazards of approximately 18 feet to the ground below in that the bucket of a Caterpillar 980G Wheel Loader was used as a work platform without fall protection. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS: Use an engineered man lift and applicable fall protection in order to access the hopper. The Caterpillar 980G Wheel Loader operating manual states, "To prevent injury, make sure that no one is working on the machine or near the machine." The Safety section of the operating manual states, "Do not allow unauthorized personnel on the equipment." 29 CFR 1903.19(c)(2) abatement of the above violation was verified at the time of inspection. No certification is required.tion
