of its employees.  In
applying this paragraph, fundamental distinctions between private and
public employment have
been recognized.
a) On November 11, 2011 at approximately 07:12 A.M., a backing accident,
involving a Town
of Mamaroneck-owned dump truck (Plate #M47929, Make - MACK, Equipment ID -
202)
resulted in the death of Town of Mamaroneck employee Robert DelVecchio Jr.
at the
Mamaroneck Town Highway Department, 40 Maxwell Avenue, Larchmont, NY 10538
A reasonable and adequate abatement method is available in that the
employer may develop and
implement policies and procedures that would correct the hazard. Examples
of
such policies and
procedures that should be considered include, but are not limited to, the
use of spotter (observer)
to provide directions for trucks and heavy equipment when appropriate,
marking passage for
vehicular traffic and pedestrians, providing personal sound alarms (air
horns), and/or require the
sounding of vehicle's horn before backing up.
