this paragraph, fundamental distinctions between private and public
employment have been
recognized.
a. Kiryas Joel Vill Sanitation Dept - Waste collection employees exposed
to vehicular traffic
were not wearing ANSI/ISEA 107-2004 high visibility outer garments when
exposed to vehicular
traffic while performing waste collection duties. Federal Rule 23 C.F.R.
Part 634 requires
workers who are working within the rights-of-way of Federal -aid highways
to wear Class 2 or
3 ANSI/ISEA 107-2004 compliant safety vests. The employer stated that the
worker Anastacio
C. Vasquez and three other workers, were not wearing reflective safety
vests while they were
collecting refuse on the village streets, on 12-11-12.
Reasonable and adequate abatement methods may include but would not be
limited to:
Develop adequate safety procedures for refuse collection according to ANSI
Z 245.1-(1992 &
1984) and compactor equipment operator's manual. This would include
ensuring that refuse
collectors are wearing ANSI/ISEA 107-2004 high visibility outer garments
when exposed to
vehicular traffic while performing waste collection duties.
* Develop and provide documented waste collection vehicle safety training
and education for
employees prior to assigning work on collection routes and to routinely
reinforce training so that
employees remain familiar with the hazards of waste collection and work
practices that are
utilized to minimize their exposure to hazards.
* Audit/supervise the workforce to determine level of compliance with
established procedures.
Workers performing tasks including but not limited to refuse collection
located on the village
roadways, are exposed to the hazard of being struck by a vehicle.
