Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about October 20, 2010, the employer did not ensure that the Caterpillar 926E Front End Loader serial number 94Z02816, equipped with forks, had a working backup alarm, exposing employees to the hazard of being run over by the equipment. Among other methods, one feasible and acceptable abatement method to correct this hazard, would be to comply with the precepts of the Association of Equipment Manufacturer's Safety Manual for Wheel Loader/Tractor equipment. In the "Check The Safety Equipment" section of this manual, it indicates to check safety equipment, such as back up alarms, and ensure that these items are securely in place and in operating condition.
