Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about November 15, 2010, during excavation work, the employer allowed an employee to be transported from the top of an excavation/trench to the bottom by riding the bucket of a Caterpillar hydraulic excavator. Among other methods, one feasible and acceptable abatement method would be to comply with the Association of Equipment Manufacturers Safety Manual for Operators and Mechanics of Hydraulic Excavators which states "WARNING: Your HYDRAULIC EXCAVATOR is a ONE-PERSON machine. NEVER PERMIT RIDERS." Never use a bucket for a work platform or personnel carrier.
