Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a)Cabinet Shop: On or about December 14, 2010, the employer did not ensure that employees were protected from struck-by hazards in that PVC pipe was used to carry compressed air instead of steel pipe or Acrylonitrile-Butadiene Styrene (ABS) pipes and fittings, which are shatter resistant and manufactured for above ground use of compressed air. Among others, one feasible method to correct this hazard is to replace the PVC pipe with steel pipe. American National Standards Institute B31.8-1986. Section 842.43 prohibits the above-ground use of PVC pipe for compressed air conveyance.
