Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from damaged storage racks: a)In the finished goods warehouse: On December 15, 2010 and at times prior to, the employer failed to repair broken and bent cross bracing and vertical supports that had been damaged by the forks of the forklift exposing employees to struck-by hazards from falling stored product and parts of a storage rack system. Feasible and acceptable methods of abatement to correct this hazard include, but are not limited to the following: The employer shall follow American National Standard Institute (ANSI) MH16.1:2008, Specification for the Design, Testing, and Utilization of Industrial Storage Racks, Section 1.4.1(2), which states, "The owner shall maintain the structural integrity of the installed rack system by assuring proper operational housekeeping and maintenance procedures including, but not limited to the following: Regularly inspect for damage. If damage is found, immediately unload the affected area and replace or repair any damaged columns, beams, or other structural components.
