Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards (a)Employee(s) were standing on an elevated pallet on the front of a rough terrain forklift without fall protection while laying a plastic tarp over a scaffold, exposing employee(s) to over 9' fall hazards. (b)Employee(s) were standing on a pallet that was not secured to the rough terrain forklift, exposing employee(s) to over 9' fall hazards. Among other methods and acceptable means to correct the hazard, one feasible method would be to ensure that a lift basket that conforms to specifications outlined in ANSI B56.6 is used. This would include securing the platform to the rough terrain forklift and install a type of fall protection system as outlined in ANSI B56.6. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
