Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards while working with hydraulic dock levelers. (a)At Dock 1, employees were manually lifting up and extending the lip of the hydraulic Poweramp Dock Leveler (Model PR 78 and Serial Number 711720) that was not working properly. The lip portion of the dock leveler did not swing out and employees had to manually pull the dock leveler out. Employees were exposed to being struck by the leveler resulting in crushing injuries. Among other methods, one feasible and acceptable method to correct these hazards is to adhere to the guidelines in the American National Standard (ANSI) MH 30.1 - 2007, For the Safety, Performance and Testing of Dock Leveling Device, Chapter 5.4 - Owner Responsibility as applicable. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
