Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees using and operating the skid-steers are exposed to struck-by and crushing hazards. On or about February 15, 2011 the hydrostatic brakes (parking/holding brakes) on the skid-steer had hydraulic fluid on them from a leaking seal; causing improper brake function and exposing the employee to crushing/struck-by hazards. Among other methods, other feasible and acceptable methods to correct these hazards are: (1)Follow Association of Equipment Manufacturers'(AEM) Safety Manual for Operating and Maintenance Personnel for Skid-Steers, section: Prepare for Safe Operation; Check the Loader. "Check the parking brake for proper operation". Conduct inspections, maintenance, and repair the skid-steer at required and regular intervals in accordance with the manufacturer's recommendations. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
