Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees are
exposed to struck-by and crushing hazards.
(a)On or about February 25, 2011, an employee was fatality injured as a
result of
being trampled by a bull while moving cattle to the milking parlor. The
employee, was herding livestock in the holding pen, was exposed to crushing
injuries while working in and around the livestock.
Among other methods, recognized and feasible means of abatement to correct
this hazard
is to follow the guidelines in the National Institute for Animal
Agriculture, Livestock
Handling Guide. Develop policies and procedures and conduct training so
that employees
are knowledgeable in the proper handling of livestock.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment
