Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling while accessing an elevated storage area with a mobile ladder that was to short and not positively secured against movement. Among other methods, one feasible and acceptable method for abatement is to prohibit use of the mobile ladder stand to gain access to the storage area in accordance to ANSI- ASC A14.7, page 12, 6-16, 2006-American National Standard for Mobile Ladder Stands and Mobile Ladder Stand Platforms.
