Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck by vehicular traffic.
a. At the worksite: An employee was working in the median installing
pavers without
high visibility safety apparel on or about 11/19/2010.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is:
a. Employees wear high visibility safety apparel (safety vest) when work
near
vehicular traffic or construction equipment. Reference the Federal Highway
Administration (FHWA), 23 CFR Part 634 of the Worker Visibility Rule which
states: "All workers within the right of way of the Federal-aid highway
who are
exposed either on traffic (vehicles using the highway for purposes of
travel)
or to
construction equipment within the work area shall wear high-visibility
safety apparel".
