Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush hazards while using a Vestil Lift Master Boom LM-EBT8 forklift attachment with broken safety latches on both hooks to unload 4,000 lbs bundles of steel rods: a)4600 N. Park Drive, Opelika, AL 36801; On or about January 25, 2011 and at times prior thereto employees were exposed to crush hazards while using a Vestil Lift Master Boom LM-EBT8 forklift attachment with broken / missing safety latches on both hooks to unload 4,000 lbs bundles of steel rods. A feasible and acceptable method to correct this hazard is to follow the American Society of Mechanical Engineers for Hooks (ASME B30.10 - 1993) Section 10-1.2.3 Maintenance, Item c., which states; "A hook latch when required, that is inoperative shall be repaired or replaced."
