Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards as the result of walking between a swinging part of A JLG Boom Lift and a concrete column near a storage shed. At the General Service Administration (GSA) track shed, Building 100, ARRA Seismic Upgrades Project, on or about 11/05/2010, an employee was injured while walking between a concrete column and a swinging part (Turntable) of a JLG Boom lift, Model No. 660SJ, Serial 0300112745. The lift was being operated by a carpentry subcontractor. The employer failed to keep non lift operating personnel at least 6(six) feet (1.8m) away from the lift during operations. JLG Operations and Safety Manual, Boom Lift Models 600S/600SJ/660SJS, Section 1 - Safety Precaution, page 1-8, bullet 5(five) requires that non machine operating personnel kept at least 6(six) feet away from machine while in operation. ONE METHOD OF ABATEMENT TO CORRECT THIS APPARENT HAZARD IS TO FOLLOW THE DIRECTION INDICATED IN THE JLG OPERATION AND SAFETY MANUAL, BOOM LIFT MODELS 600S/600SJ/660SJ, SECTION 1 - SAFETY PRECAUTIONS THAT STATES "KEEP NON-OPERATING PERSONNEL AT LEAST 6 FT (1.8M) AWAY FROM MACHINE DURING ALL DRIVING AND SWING OPERATIONS".
