Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with: Location: Shop The employer did not provide an adequate guarding device for the manually operated Pexto, model #137-L, serial #910-7-79 jump shear to protect employees from the point of operation. On November 5, 2010 an employee suffered an amputation to the left middle finger to the first knuckle, while operating the manually operated Pexto, model #137-L, serial #910-7-79 jump shear.
