Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards associated with entering a structure damaged by snow loads: Jobsite: The company allowed employees to enter the loading dock area to retrieve materials and equipment following the collapse of the roof. The structural engineer who evaluated the building had determined that the loading dock was unsafe to enter. Among other methods, one feasible and acceptable abatement method to correct the hazard was to wait until the loading dock roof and supporting structure had been removed from the building and a structural engineer had determined that the loading dock was safe to enter.
