Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with: Jobsite: Employees were exposed to fall and struck-by hazards from the following: a) Employees were 'tied off' to the transportable counterweighted outrigger (mule), instead of an independent anchorage. b) The mule tie back had approximately 40 feet of slack. c) An employee on the roof was not wearing a full body harness and his personal fall arrest system did not otherwise comply with ANSI Z359.1. d) The mule was not tied back to a certified anchorage using a wire rope less than 5/16 inch in diameter. e) The mule was moved while an employee was suspended in the rope descentsystem seat. Among other feasible and acceptable abatement methods to correct these hazards, but not limited to, is to comply with ANSI / IWCA I-14.1 2001 Window Cleaning Safety Standard, and to ensure that all employees are adequately trained in accordance with Appendix B of the ANSI Standard.
