Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall, struck-by and caught between hazards while stocking
retail goods and
products utilizing a material lift that had not been properly inspected,
maintained and constructed
in accordance with ASME A17.1-2004, Part 7 requirements.
GENERAL STORE BACK ROOM:
An employee fell 8 feet to the floor below while working where a material
lift had not
been properly inspected, maintained and constructed.
Among other methods, feasible and acceptable abatement methods to correct
this hazard are:
1.Discontinue use and remove the existed material lift from the
establishment.
2.Replace, modify or reconstruct the existing material lift in accordance
with AMSE A17.1-
2004, Part 7, Dumbwaiter and Material Lift requirements.
3.Provide material lift training to exposed employees on the safe
operation, maintenance and use
of the approved material lift.
